MEMBERSHIP AGREEMENT

Please read the agreement below carefully before registering as a member of our website.

1. Parties

a) Just Choco, located at Battalgazi Mah. Selçukhan Cad. No:155/A Sultanbeyli/Istanbul, operating the website www.justchoco.com,
b) The internet user who registers as a member of the website www.justchoco.com ("Member").

2. Subject of the Agreement

The purpose of this Agreement is to set forth the terms and conditions for the Member’s use of the website www.justchoco.com, which is owned by Just Choco.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that all personal and other information provided during registration is true and correct before the law and that they shall indemnify Just Choco immediately and in full for any damages resulting from the inaccuracy of such information.

3.2. The Member may not share their password provided by Just Choco with any third party or organization. The Member is solely responsible for maintaining the confidentiality of their password. Just Choco reserves all rights to compensation and claims arising from any unauthorized use and any related legal demands brought by third parties or authorities.

3.3. The Member agrees in advance to comply with all applicable legal regulations when using the website www.justchoco.com. The Member shall be solely responsible for any legal or penal liability that may arise otherwise.

3.4. The Member shall not use the website www.justchoco.com in any way that disrupts public order, violates general morality, causes discomfort or harassment to others, or infringes on the rights of third parties, including intellectual property rights. Additionally, the Member shall not engage in any activities (such as sending spam, viruses, trojans, etc.) that may hinder or complicate the use of the website by others.

3.5. Opinions and thoughts expressed, written, or used by Members on www.justchoco.com are entirely their own and reflect only the personal views of the Member. These views have no relation or connection with Just Choco. Just Choco shall not be liable for any damages incurred by third parties due to Member views, nor for damages incurred by Members due to third-party views.

3.6. Just Choco shall not be responsible for unauthorized access to Member data or for any damage to software or data arising from use of the website. The Member accepts in advance not to claim any compensation from Just Choco for any loss or damage resulting from the use of the website www.justchoco.com.

3.7. The Member agrees not to access or use other users’ software or data without authorization. Otherwise, the Member shall bear all resulting legal and penal responsibilities.

3.8. The Member shall be personally liable, both legally and criminally, for violating one or more provisions of this agreement and shall hold Just Choco harmless from any legal or penal consequences arising from such violations. In the event that legal action is taken, Just Choco reserves the right to claim compensation from the Member due to breach of this agreement.

3.9. Just Choco reserves the right to unilaterally delete the Member’s account and any associated files, documents, or information at any time, without prior notice. The Member hereby accepts this action in advance. Just Choco shall not be held liable in such cases.

3.10. The software and design of www.justchoco.com are the property of Just Choco and are protected by copyright and/or other intellectual property laws. They may not be used, acquired, or altered by Members without permission. Other companies and products mentioned on this website are trademarks of their respective owners and are also protected by intellectual property laws.

3.11. In order to improve and develop www.justchoco.com or within the scope of legal regulations, Just Choco may collect certain data such as the name of the Internet service provider, the IP address used to access the site, the date and time of access, the pages visited during the session, and the web address that referred the user to the site.

3.12. Just Choco may disclose a Member’s personal data when required by law or when it believes in good faith that such disclosure is necessary to: (a) comply with legal obligations or official procedures served to Just Choco, or (b) protect and defend the rights and property of Just Choco and the www.justchoco.com website family.

3.13. Measures have been taken to ensure that www.justchoco.com is free of viruses and similar malicious software. However, the Member is responsible for maintaining their own antivirus software and system security. By accessing the website, the Member agrees that they are solely responsible for any errors or losses arising from their own software or operating system.

3.14. Just Choco reserves the right to modify the content of the site, change or discontinue any services provided, and delete user data and information at any time.

3.15. Just Choco may update, amend, or terminate the provisions of this agreement at any time without prior notice. All changes shall take effect upon publication and shall be binding for all Members.

3.16. The parties agree that all computer records belonging to Just Choco shall constitute exclusive and conclusive evidence in accordance with Article 287 of the Turkish Code of Civil Procedure (HMK), and that such records shall be accepted as a binding evidentiary contract.

3.17. Under this Membership Agreement, Just Choco has the authority to send informational emails to the Member’s registered email address and SMS messages to their mobile phone. Upon approval of this agreement, the Member is deemed to have accepted the receipt of such emails and messages.

4. Termination of the Agreement

This agreement shall remain in effect until the Member cancels their membership or Just Choco terminates the membership. If the Member violates any provision of the agreement, Just Choco may unilaterally cancel the membership and terminate the agreement.

5. Dispute Resolution

For any disputes arising from this agreement, the courts and enforcement offices of Istanbul shall have jurisdiction.

6. Effectiveness

By registering as a Member, the user agrees that they have read and accepted all the terms and conditions stated in this Membership Agreement. This Agreement is deemed to have been executed and entered into force at the moment of registration.
